JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 47(A) of the Excise Act.
Neither petitioner was caught on the spot nor anything was recovered from his conscious possession and it is stated that petitioner and one Yogesh Kumar Paswan managed to escape from the place of occurrence.
Submission on behalf of the petitioner is that coaccused, Yogesh Kumar Paswan has already been granted privilege of anticipatory bail by a co-ordinate Bench of this Court and in course of investigation, it came to light that seized
Patna High Court Cr.Misc. No.28616 of 2016 (2) dt.19-07-2016 2/2 motorcycle belongs to co-accused, Yogesh Kumar Paswan. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Chandauti (Chakand) P.S. Case No. 67 of 2016.
