JUSTICE ARUN KUMAR ORAL ORDER 12-02-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody, seeks bail in Sohsarai PS Case No. 25 of 2017 registered under Sections 307/34 of the IPC and Section 27 of the Arms Act.

The allegation in brief is that due to property dispute while the informant was parking his vehicle in the night then his elder brother (the petitioner) along with other persons started abusing and opened fire causing injury in his right hand. Learned Counsel for the petitioner submits that the petitioner is full brother of the informant and due to property dispute he has been implicated, the so called injury is on non vital part of the body simple in nature and the petitioner is in custody since 15.11.2017. Having considered the said facts and circumstances, the petitioner, namely, Raj Kamal Kumar @ Pappu Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM VII, Nalanda in connection with Sohsarai PS Case No. 25 of 2017.
