The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 448, 323, 379 and 354B/34 of the Indian Penal Code. It is alleged that the petitioner along with others entered into the house of the informant, outraged her modesty, snatched gold ornaments and demand Rs.50,000/- as extortion.

It is submitted by learned counsel for the

No.33993 of 2015 (2) dt.31-08-2015 2/3 petitioner that the petitioner purchased some land from the husband of the informant through registered sale deed dated 13.02.2013 on payment of consideration amount of Rs.2,33,000/- , but subsequently the agnates of the informant started disturbing the petitioner's possession when the petitioner requested the husband of the informant to look into the matter then the husband of the informant filed Hajipur Town P.S. Case No. 570 of 2013 making accusation under Sections 342, 323, 504, 506/34 of the IPC and 138 of N.I. Act and Complaint Case No. 4343 of 2013 levelling accusation under Sections 406 of the IPC and 138 of N.I. Act. But when the petitioner has been granted bail in both the cases the present case has been lodged with malicious accusation and apart from the aforesaid two cases the petitioner is not accused in any other case.

Considering the accusation levelled in the background of dispute between the parties from before, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur
