The petitioner seeks bail in connection with Excise Case No. 226 of 2016 registered for the offences punishable under section 47(a), 54 and 57 of the Bihar Excise (Amendment) Act, 2016.

According to the first information report six bottles of liquor was recovered from a bag which was on a motor cycle bearing registration No. BR-06E- 2373. Apart from the aforesaid six bottles, 32 bottles of Royal Stag foreign liquor was recovered from a bush near the place of occurrence. It is submitted that the motor cycle in question is

No.35192 of 2016 (2) dt.20-08-2016 not registered in the name of the petitioner and the owner of the said vehicle is one Abhijeet son of Mohan Tiwary resident of Bela Road, Mithunpura, Muzaffarpur. He further contended that the petitioner is an old man aged about 60 years and has nothing to do with the bottles of wine recovered from the place of occurrence. Regard being had to the fact that the petitioner is in jail since 25.07.2016, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Excise Case no. 226 of 2016.
