JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 406, 420, 341, 323, 504, 506 of the Indian Penal Code.
Petitioner is said to have taken rupees three lacs from the informant in the name of providing job to him in the Railway. The investigation against the petitioner appears to have already been completed. The impugned order reveals that except oral statements of witnesses, there is nothing on the entire case diary to show this fact that informant had given rupees three lacs to the petitioner.
Considering the aforesaid facts and circumstances as
