The petitioner has preferred this application for grant of regular bail in a case registered under sections 363, 365, 367, 368 and 34 of the Indian Penal Code and sections 8 and 12 of the POCSO Act.
As per the prosecution case, three accused persons namely Sintu Kumar, Shashi Kumar and Jitendra Kumar Manjhi made an attempt to kidnap the daughter of the informant but were caught at the place of occurrence itself. It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. He has been falsely implicated in the case when his name was allegedly taken in course of investigation in the confessional statement of coaccused Jitendra Kumar Manjhi. The petitioner is in custody

Having heard learned counsel for the parties and taking into consideration the contents of the F.I.R., the petitioner not being named therein and having remained in custody for over 1 year 4 months, the Court directs the petitioner to be enlarged on bail in connection with Special Case no.205 of 2020 (arising out of Shahjahanpur P.S. Case no. 59 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, VII-cum-Exclusive Special Court (POCSO Act), Patna.
