The petitioner seeks bail in Gopalganj P.S. Case No. 603 of 2019 corresponding to Sessions Trial No. 178 of 2021, registered for the offence punishable under Section 307, 323 and other allied sections of the Indian Penal Code. Earlier the bail application of petitioner was rejected vide order dated 24.08.2021. It is submitted that due to mistake, this fact was not brought to the notice of this Court that petitioner is not assailant of the deceased. As per the FIR, petitioner assaulted by lathi on the head of informant causing grievous injury. It is next submitted that charge has already been framed and petitioner is having clean antecedent and he is in

Patna High Court CR. MISC. No.19886 of 2022(2) dt.20-04-2022 2/2 custody since 05.01.2021.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned District & Sessions Judge, Gopalganj in connection with Gopalganj P.S. Case No. 603 of 2019 corresponding to Sessions Trial No. 178 of 2021.
