This is an application for regular bail in connection with Trial No. 45 of 2017 arising out of Bettiah Town P. S. Case No. 389 of 2017 registered for the offences punishable under Sections 401 and 414 of the Indian Penal Code and under Sections 20, 22, 23, 24, 27A and 29 of the Narcotic Drugs and Psychotropic Substances Act.

According to informant, who is Assistant Sub-Inspector, on receiving information that some miscreants assembled near New Bus Stand, he proceeded to nab them but on seeing the police party, they tried to flee away but three out of five miscreants were caught and two succeeded to escape away. Two hundred grams of charas from the seat of the motorcycle was recovered.

Patna High Court Cr.Misc. No.445 of 2018(2) dt.17-01-2018 2/2 It is submitted on behalf of the petitioner that he is innocent and has falsely been implicated in the present case. Recovery was not made from the conscious possession of the petitioner. He has got no criminal antecedent and is in custody since 30.05.2017.

Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned 1st Additional District and Sessions Judge-cum-Special Judge, West Champaran at Bettiah in connection with Trial no. 45 of 2017 arising out of Bettiah Town P.S. Case no. 389 of 2017. (S. Kumar, J) sudip/- U
