JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-11-2017 Earlier prayer for bail of the petitioner was dismissed vide order dated 20.09.2017 passed in Cr. Misc. No. 46483 of 2017 with observation that petitioner may renew his prayer for bail after framing of charge in this case.

Submission of learned counsel for the petitioner is that now charge has been framed in this case on 31.10.2017 and petitioner has been in custody since 05.08.2017 and is ready to abide by any condition imposed on him for grant of bail.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts as well as in view of the order dated 20.09.2017 passed in Cr. Misc. No. 46483 of 2017, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Sri V.C. Verma, J.M. 1st Class, Darbhanga, in connection with Darbhanga Town P.S. Case No. 62 of 2016, subject to the following conditions:-

Patna High Court Cr.Misc. No.56858 of 2017 (2) dt.29-11-2017 (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner shall mark his attendance in the concerned police station of his area in the first week of each month at least for a period of one year so that the police may watch his conduct during the said period.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the Court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
