JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-09-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 363/366(A)/34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with other accused persons are alleged to have kidnapped the minor daughter of the informant for the purpose of marriage or other immoral purposes.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case due to village politics. Petitioner is in custody since 05.12.2020 and charge sheet has already been submitted in this case.

Patna High Court CR. MISC. No.28778 of 2021(3) dt.27-09-2021 2/2 Learned counsel appearing for the State opposes the prayer for bail and submits that petitioner is named in the FIR and the victim is still traceless.

Considering the facts of the case and the gravity of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
