JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 15-05-2024 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner has renewed his prayer for bail which was earlier rejected vide order dated 08.08.2023 passed in Cr. Misc. No. 43694 of 2023.
As per allegation in the F.I.R, the informant alleged that his sister was married with the petitioner in the year 2020 and thereafter, the petitioner along with his family members subjected her to cruelty due to nonfulfillment of dowry demand. Ultimately, on 09.11.2022, the informant came to know that his sister was
Patna High Court CR. MISC. No.24128 of 2024(3) dt.15-05-2024 2/3 murdered by all her in-laws family members including the petitioner.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case since he is unfortunate husband of the deceased. There is no prior complaint regarding assault, torture of demand of dowry against the petitioner and other family members. The petitioner has got no criminal antecedent and he is languishing in custody since 17.02.2023.
In pursuance to the direction of this Court, a report with regard to the present stage of the trial has been received which has been kept at Flag-A. The report of learned Additional District & Sessions Judge-VIII, Bettiah, West Champaran dated 20.04.2024 suggests that trial shall be concluded within a period of six months.
Having considered the facts and circumstances of the case, this Court is not inclined to take a different
Patna High Court CR. MISC. No.24128 of 2024(3) dt.15-05-2024 3/3 view in the matter. The prayer for grant of bail to the petitioner stands rejected.
The Trial Court is directed to expedite the trial and conclude the same at the earliest preferably within the stipulate period of time as mentioned in its report. The petitioner shall be at liberty to renew his prayer for bail, if the trial is not concluded within a period of six months.
