JUSTICE SUDHIR SINGH ORAL ORDER 14-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 419 and 420 of the I.P.C. The prosecution case, in short, is that a Board was constituted for verification of original papers as well as medical examination of the candidates, who have been selected for the post of Constable by the Staff Selection Board, but during examination it was found that the signature and writing of the petitioner did not tally with the signature and L.T.I. available on written examination and on being asked the petitioner stated before the Board that another person appeared on his behalf in the written examination.
It has been submitted on behalf of the petitioner that
Patna High Court Cr.Misc. No.30991 of 2016 (3) dt.14-09-2016 2/2 the petitioner is in custody since 11.5.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The petitioner is of tender age. He has sufficiently been punished.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Jogbani (Bathnaha) P.S. case No.61 of 2016.
