====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 09-12-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Bibhutipur/ Vibhutipur P. S. Case No.111 of 2020, instituted for the offences under Sections 420 and 409 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 01.12.2020 and charge-sheet has been submitted in this case.

The learned counsel for the petitioner further submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that petitioner is a Ward Secretary of Gram Panchayat Karrakh (Desri) Ward No.7, and for implementation of Nal-Jal Yojna worth Rs.13,73,300/- was transferred in the account of the said ward, but the accused/ petitioner has completed the work yet as is evident from the report of the

The learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that the allegation does not even remotely suggest that there is allegation of misappropriation of any government money rather the allegation is that the work till date has not been completed.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 01.12.2020, charge-sheet has been submitted in this case and there is no allegation of misappropriation of the government money, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- 2nd, Rosera, Samastipur in connection with Bhibutipur/ Vibhutipur P. S. Case No.111 of 2020. The application stands allowed.
