Mr. Mithlesh Kumar Khare, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-09-2022 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 366(A), 34 of the Indian Penal Code and Section 8 of the POCSO Act. It is a case of abduction of the daughter of the informant.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that the victim was recovered and her statement

Patna High Court CR. MISC. No.19952 of 2022(2) dt.21-09-2022 2/2 was recorded under section 164 of the Cr.P.C. wherein she stated that she has solemnized the marriage with co-accused Sanoj Kumar as is evident from the impugned order. He further submits that petitioners are the family members of the main coaccused Sanoj Kumar. Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge-cum-Special Judge, POCSO Act, East Champaran at Motihari in connection with Raxaul P.S. (Haraiya O.P.) Case No. 432 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
