The petitioners seek anticipatory bail in a case instituted for the offences under Sections 341, 323, 504, 506, 379, 354(B)/34 of the Indian Penal Code and Section and section 3(1)(x) of the SC/Sc Act.
Learned counsel for the petitioner seeks permission to withdraw this application against petitioner no.1 Bhagya Narain Bhagat as the same has become infructuous. Permission is accorded. Accordingly this application as against petitioner no.1, Bhagya Narain Bhagat, is dismissed as having become infructuous.
Allegation has been made that the water was flowing
Patna High Court Cr.Misc. No.39800 of 2014 (2) dt.27-03-2015 from the land of the petitioners and they have objected for flow of water over the land. Allegation has been made against the petitioners that they abused the informant with his caste name and also caught hold the hair and torn the garment. Having considered the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioner no.2, Satendra Bhagat, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in P.S. Case No.Muzaffarpur SC/ST P.S. Case No.94 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
