The petitioner has preferred this application for grant of regular bail in a case registered under sections 272 and 273 of the Indian Penal Code and sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, it is stated that secret information was received that the five named accused persons including the petitioner herein assist Nagendra Singh in dealing in illicit liquor. Further, on a raid being conducted, it is stated that a total of about 3200 litres of liquor was recovered from the house and vehicle of the said Nagendra Singh. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the

Patna High Court CR. MISC. No.29007 of 2021(2) dt.10-12-2021 2/2 petitioner's possession who has been falsely implicated in the case because of his antecedent. He is in custody since 3.2.2021 and chargesheet has been submitted in the case. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case especially the petitioner having remained in custody for more than 10 months, the Court directs the petitioner to be enlarged on bail in connection with Daraunda P.S. Case no.184 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District and Sessions Judge-cum-Special Judge, Excise, Siwan.
