Permission is accorded. The necessary correction be done during course of the day.

Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Hasanpur P.S. Case No. 206 of 2020, registered for the offence punishable under Section 302/34 and 120B of the Indian Penal Code and section 27 of the Arms Act.

Earlier the bail application of petitioner was rejected vide order dated 18.11.2021. It is submitted on behalf of petitioner that informant Shambhu Singh was examined and

No.19922 of 2022(2) dt.20-04-2022 2/2 cross examined as PW-3 wherein he has denied the fact that there was money transaction between his nephew (deceased) and the petitioner and also stated that petitioner was not involved in the murder of the nephew of informant. Petitioner claims clean antecedent and he is in custody since 15.04.2021. Considering the deposition of informant (PW-3) and the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge II, Rosera, Samastipur in connection with Hasanpur P.S. Case No. 206 of 2020.
