JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 414 of the Indian Penal Code. One Md. Firoj was arrested and disclosed that he as well as petitioner and others had committed theft of motorcycle and on the basis of disclosure made by the aforesaid co-accused Md. Firoz, some parts of the motorcycle, kept in a bag, were recovered from the house of the petitioner. The petitioner is in jail custody since 29.01.2016 and does not have any criminal antecedent.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on
Patna High Court Cr.Misc. No.30915 of 2016 (2) dt.09-08-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri R.K. Yadav, Judicial Magistrate, Saran, Chapra in connection with Baniyapur P.S. Case No. 189 of 2015.
