JUSTICE ARUN KUMAR ORAL ORDER 17-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Bachwara PS Case No. 187 of 2015 registered under Sections 328 and 302/34 of the IPC.

Submission is that the allegation of administering poison to the deceased is not found correct during investigation. Police has submitted final form but cognizance has been taken. There is no material to show that the petitioner is involved in the occurrence, he is a retired teacher of 67 years of age and charge too has been framed against the petitioner. Similarly situated co-accused have been admitted to bail by a co-ordinate Bench of this Court. Having considered the said facts and circumstances, the petitioner, namely, Md. Matin @ Md. Matin Miyan @ Matin Miyan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Teghra, District Begusarai in connection with Bachwara PS Case No. 187 of 2015.
