The petitioner seeks bail in connection with Chausa P.S. Case No. 310 of 2017 registered under Sections 30(a) of Bihar Prohibition and Excise Act-2016.
5 lts. of country made liquor is said to have been recovered each from two motorcycles parked on the door of Bangatu Singh while 10 lts of illicit country made liquor recovered from the house of said Bangatu Singh, petitioner and one other accused namely, Pintu Yadav were apprehended sitting on the Machan in front of the door of Bangatu Singh while four other persons managed to escape.
It is submitted by learned counsel for the petitioner
Patna High Court Cr.Misc. No.1625 of 2018 (2) dt.24-01-2018 2/2 that no incriminating article has been recovered from his conscious physical possession. Motorcycle, in question, is hailing to one Pintu Singh and Arun Singh. Petitioner has no criminal antecedent. He has been languishing in custody since 01.11.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Uda-Kishunganj, District-Madhepura in connection with Chausa P.S. Case No. 310 of 2017.
