JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 01-07-2026 Learned counsel for the petitioners seeks permission to withdraw the bail application with respect to petitioner no.1, namely, Krishna Nand Yadav, since during the pendency of the case, he has been arrested.

2. Permission is accorded.

3. Accordingly, the bail application with respect to petitioner no.1, namely, Krishna Nand Yadav is dismissed as withdrawn.

4. Heard learned counsel for the petitioner no.2 and learned A.P.P. for the State.

5. The petitioner no.2 apprehends his arrest in a case

Patna High Court CR. MISC. No.21415 of 2026(3) dt.01-07-2026 2/3 registered under Sections 316(2), 316(5), 318(5) and 3(5) of Bharatiya Nyaya Sanhita.

6. As per prosecution case, it is alleged that petitioner nos.1 & 2 being the chairman and manager of the PACS respectively had not supplied 658.93 quintals of paddy to SFC which is valued at Rs. 15,15,539/-. It is also alleged that they had cheated the government with the said amount of Rs. 15,15,539/-.

7. Learned counsel for the petitioner no.2 submits that petitioner no.1 is innocent and has falsely been implicated in the present case. Learned counsel for the petitioner no.2 further submits that the claim amount has already been deposited by the petitioner no.1 and the bank has given no due certificate in this regard to the PACS concerned, a copy of same is annexed as annexure P/2 to the application. Petitioner no.2 has no criminal antecedent, he undertakes to cooperate in the investigation and trial.

8. Learned A.P.P. appearing on behalf of the State and B.S.F.C conceded that the said amount has been deposited and no dues certificate has been issued in this regard.

9. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let
