JUSTICE RAKESH KUMAR ORAL ORDER 11-07-2016 Heard Sri Mithilesh Kumar, learned counsel for the petitioners and Smt. Veena Kumari Jaiswal, learned A.P.P. Two petitioners, who are in custody in connection with Maharajganj P.S. Case No. 67 of 2016 registered for the offence under Section 47 of the Bihar Excise Act, have prayed for grant of regular bail.
It was submitted by learned counsel for the petitioners that some quantity of country made liquor was shown recovered from possession of the petitioners.
Learned A.P.P. has opposed the prayer of bail and
Patna High Court Cr.Misc. No.26682 of 2016 (2) dt.11-07-2016 2/2 submits that offence is very serious.
Be that as it may, keeping in view the nature of accusation , let both the petitioners namely Teni Choudhary and Dilip Choudhary be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. II at Siwan in connection with Maharajganj P.S. Case No. 67 of 2016.
