ANJANA PRAKASH ORAL JUDGMENT Date: 18-08-2015 The Petitioner seeks quashing of the First Information Report of Sasaram (Mufasil) P.S. case No.1184 of 2011 pending in the court of Chief Judicial Magistrate, Rohtas at Sasaram on the ground that it is vexatious prosecution.
A report was called for from the Officer Incharge, Sasaram (Mufasil) with regard to the present status of investigation, which has been received. From it, it appears that charge sheet has already been submitted as against eight persons, whereas the investigation appears to be going on as against the present Petitioner. Since the investigation should be rarely interfered with, I am not inclined to interfere in the matter.
The Investigating Officer is directed to conclude the investigation positively as against the Petitioner also within a period
Patna High Court Cr.Misc. No.50252 of 2012 dt.18-08-2015 2/2 of three months from the date of receipt of this order, since it is an old case.
With the aforesaid observations, the application stands disposed of.
Let this order be communicated to the Superintendent of Police, Rohtas at Sasaram through FAX at the cost of the Petitioner for its onward transmission to the Investigating Officer in connection with Sasaram (Mufasil) P.S. case No.1184 of 2011 pending in the court of Chief Judicial Magistrate, Rohtas at Sasaram.
