JUSTICE BIRENDRA KUMAR ORAL ORDER 08-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Naubatpur P.S. Case No. 81 of 2017 a case under Section 376 of the Indian Penal Code and Section 4 and 8 of the POCSO Act, pending in the Court of learned Additional Sessions Judge-I, Patna. Allegation against the petitioner is of commission of rape against the minor daughter of the informant, aged 7 years. The victim has supported the allegation before the police as well as to the informant. The petitioner is in custody since 28.03.20017. Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail is refused. The learned trial Court is directed to expedite the trial.
