JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-04-2015 Heard learned counsel for the petitioner and the state. The present application has been filed for modification of order dated 20.4.2010 passed in Cr. Misc. No. 44707 of 2009 for extending the period of surrender.
The petitioner was granted anticipatory bail vide Cr. Misc. No. 44707 of 2009. The petitioner was to execute the bail bond within a period of one month. The said order was modified vide order dated 8.5.2013 passed in Cr. Misc. No. 20412 of 2013 whereby the periods of surrender and executing the bail bond were extended by four weeks.
The present application has again been filed for extending the period of surrender on the ground of illness of the petitioner.
Be that as it may, this court is not inclined to entertain the present modification application. However, let the learned
Patna High Court Cr.Misc. No.46230 of 2014 (2) dt.16-04-2015 2/2 court below consider the prayer for regular bail of the petitioner keeping in view the fact that the petitioner was granted anticipatory bail on merits in case the petitioner surrenders within six weeks from today in connection with Sultanganj P.S. Case No. 26 of 2009 pending in the court of learned C.J.M., Bhagalpur. The modification application stands disposed of accordingly.
