Petitioner seeks bail in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

Petitioner is not named in the FIR.

Submission is that the matter is of love affairs between the victim and one Dhiraj which would be evident from the statement of the victim recorded under Section 164 Cr.P.C. in an early case vide Masaurhi P.S. Case No. 202 of 2017 wherein she had alleged commission of rape by Dhiraj and insistence for marriage by Dhiraj.

Considering the fact that the petitioner is not named in the FIR, let the petitioner, above named, be released on

Patna High Court Cr.Misc. No.1346 of 2018 (3) dt.16-03-2018 2/2 bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Konch Police Station Case No. 168 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
