JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419,420,384 and 500 of the Indian Penal Code.
The prosecution case is that the petitioner was given photographs, original certificates of the informant and rupees one lac for providing employment but the petitioner is misusing the photographs of the informant as a result she is apprehensive that the proposed marriage of the informant may break. It is submitted by the learned counsel for the petitioner that the petitioner was in love with the informant and this fact gets reflected from the written report submitted to the Officer Incharge of Hawai Adda Police station by the informant where she has
Patna High Court Cr.Misc. No.37579 of 2015 (2) dt.17-09-2015 2/2 admitted that she wants to marry with the petitioner. The said written report has been brought on record as Annexure 3. Subsequently, the informant married with one Babloo Kumar and the issue was settled that none will interfere with each other's affair. There is counter version of the occurrence as the petitioner has filed a case against the father of the informant making accusation of assault.
Considering the nature of accusation and Statement made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Patna in connection with Hawai Adda P.S. Case No.59 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
