JUSTICE SUDHIR SINGH ORAL ORDER 06-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 323, 341, 307 and 302 of the Indian Penal Code.

Allegation is that when informant, his brother and father were collecting mango in the orchard, the accused persons came with variously armed and assaulted them. Informant's father died in course of treatment.

It has been submitted on behalf of the petitioner that he is in custody since 17.3.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. General and omnibus allegation has been made against the petitioner. No specific overt act has been alleged against the petitioner. It is a case and counter case between the parties. The date of occurrence is 13.6.2015. F.I.R. has been instituted on 24.6.2015. Delay has not been explained by the prosecution. Other co-accused have been granted bail vide Annexures- 3 and 4 to the present application.

On behalf of the State, it is submitted that petitioner is

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, in connection with Sangrampur P.S. Case no. 76 of 2015.
