JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-02-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with S. Tr. No. 1134 of 2013, arising out of Akbar Nagar P.S. Case No. 4 of 2010 registered under Sections 147, 148, 342, 323, 324, 326, 307, 332, 333, 379, 380 and 352 of the Indian Penal Code and Section 27 of the Arms Act.

This is a case of misuse of privilege of bail by the petitioner for about two and half years.

Learned counsel for the petitioner submits that petitioner had gone outside the State for his livelihood due to that reason he could not present in the court below and he is in custody since 10.05.2017. Further submission is that petitioner undertakes

Patna High Court Cr.Misc. No.3444 of 2018 (2) dt.07-02-2018 that he will not misuse the privilege of bail in future. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Ist Additional Sessions Judge, Bhagalpur, in connection with S. Tr. No. 1134 of 2013, arising out of Akbar Nagar P.S. Case No. 4 of 2010. Out of two sureties, one surety must be the close relative of the petitioner.
