JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2015 The present application has been filed for modification of the order dated 03.04.2013 passed in Cr. Misc. No. 6454 of 2013, for confirmation of provisional bail. The petitioner was granted provisional bail on undertaking that he will keep the informant with dignity and honour. The provisional bail of the petitioner was to be confirmed by learned Court below on substantial restoration of matrimonial harmony within a period of one year, or if the informant deliberately refuses to reside with the petitioner or if she fails to appear before learned Court below.
It is submitted by learned counsel for the petitioner that in pursuance to the order the informant went to the matrimonial house and resided for some time and thereafter she filed Gopalganj Mahila P.S. Case No. 31 of 2013 with accusation under Sections 323, 341, 498A/34 of the I.P.
Patna High Court Cr.Misc. No.42996 of 2014 (2) dt.04-02-2015 2/2 order dated 21.03.2014 passed in Cr. Misc. No. 6728 of 2014. Considering the fact that petitioner has been granted regular bail in subsequent case, there is no reason that petitioner may not be allowed bail, let learned Court below pass appropriate order on the prayer for regular bail of the petitioner, preferably on the same day, if the petitioner surrenders within a period of six weeks before learned Court below in connection Uchka Gaon P.S. Case No. 259 of 2012. Accordingly the modification application is disposed off.
