Petitioner seeks bail in connection with Special Case No. 5 of 2018, arising out of Gogri P.S. Case No. 251 of 2018 registered for the offence punishable under sections 274, 275, 276, 419, 420, 467, 468 and 120B of the I.P.C. and Sections 27(b)(ii)/27(d)/28(A) and 22(b) of the NDPS Act, 1985.

Learned counsel appearing for the petitioner submits that merely on confessional statement of co-accused, petitioner has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither the drug seller nor the drug purchaser rather he is only a grossary shopkeeper. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of District and Sessions Judge-cum-Special Judge, Khagaria in connection with Special Case No. 05 of 2018, arising out of Gogri P.S. Case No. 251 of 2018.
