ANJANA MISHRA ORAL ORDER 17-02-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 10.11.2017 in connection with Bhagwan Bazar P.S. Case No.429 of 2017, G.R. No.7710 of 2017, registered for the offence under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the recovery was made from the petitioner's possession, it was not know to him that the motorcycle in question was allegedly a stolen vehicle. It is submitted that the petitioner had purchased the motorcycle from one Prakash Kumar, who, in turn, purchased the same from the person being involved in the theft of the vehicle.

No.3867 of 2018 (3) dt.17-02-2018 2/2 Having considered the entire facts and circumstances of the case and that the petitioner is not having criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran, Chapra, in connection with Bhagwan Bazar P.S. Case No.429 of 2017, G.R. No.7710 of 2017.
