The petitioner apprehends his arrest in a case under Sections 409, 467, 468 and 379 of the Indian Penal Code. The petitioner was posted as a Revenue Clerk in Circle Office, Jamalpur and he was on unauthorized leave and, on account of such, an inventory of revenue receipts was prepared by the order of the Sub Divisional Officer. It was found that many revenue receipts of Halka Nos. 1 & 3 were missing. It was found that in Register II, many interpolations were made and, accordingly, charge of the aforesaid Halka Nos. 1 & 3, after preparing inventories, was handed over to Sri Rajendra Pathak and Sri Chiranjiwi Singh, Revenue Clerks. Learned counsel for the petitioner submits that the petitioner was asked to show cause and he gave his explanation to the Circle Officer, Jamalpur, who

Patna High Court Cr.Misc. No.36052 of 2015 (3) dt.03-11-2015 2/2 reported that the petitioner gave explanation that the case was lodged due to mala fide intention. Interpolations made in the Register II can be corrected though they are not in the handwriting of the petitioner. It is further submitted that even the revenue receipts can be prepared after collecting counter-foils of the same from the land owners.

It appears that many revenue receipts were missing and the petitioner is responsible for that. Even in the Register II of Halka Nos. 1 & 3, interpolations at large scales are made. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Jamalpur P.S. Case No. 50/2015. Accordingly, the same is rejected.
