JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B), 201, 34 of the Indian Penal Code.
Petitioner happens to be husband of the deceased, who died in other than normal circumstances within two months of her marriage and according to prosecution case, prior to her death she was subjected to cruelty and harassment on account of non fulfilment of illegal demand. The impugned order goes to show that in course of investigation, the witnesses supported the aforesaid fact and inquest report as well as post mortem report also corroborate the allegation.
Patna High Court Cr.Misc. No.30602 of 2016 (2) dt.08-08-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Amba P.S.
