The petitioner seeks bail in a case instituted for the offences under Section 376/511 of the Indian Penal Code. The prosecution case in short is that while the informant was on the way, the accused person caught her with bad intention but, on hulla, the accused person fled away. It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.2.2019 and has got no criminal antecedent. Due to previous enmity, the present case has been instituted. No rape has been committed upon the victim. At best, it is a case for offence under Section 354 IPC.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R..

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 13th A.D.J., Muzaffarpur in connection with Sessions Trial No. 792/2016 arising out of Mushahari P.S. Case No. 139/2012 (Sudhir Singh, J) Pankaj/- U T
