JUSTICE ANIL KUMAR SINHA ORAL ORDER 25-07-2019 The petitioners apprehend their arrest in connection with Trial No. 4136 of 2018 arising out of Complaint Case No. 124 of 2018 registered under Section 498A of the Indian Penal Code.

Allegation against the petitioners is that petitioners along with other family members demanded one motorcycle from O.P.No. 2 i.e., complainant, and due to non-fulfillment of demand, she was being tortured physically and mentally by the petitioners.

Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and allegation against them

Patna High Court CR. MISC. No.19453 of 2019(6) dt.25-07-2019 2/2 is general and omnibus. He further submits that petitioner no. 1 is Bhaisur and petitioner no. 2 is Gotani of O.P.No. 2. Nobody appears on behalf of O.P.No. 2. Yesterday also, nobody was appearing on her behalf.

After having heard learned counsel for the parties and taking into consideration the fact that petitioners are Bhaisur and Gotani of O.P.No. 2 and further that allegation made in the complaint appears to be general and omnibus in nature against them, accordingly, I am inclined to grant anticipatory bail to the petitioners.

Let the petitioners, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned SDJM, (West) Muzaffarpur in connection with Trial No. 4136 of 2018 arising out of Muzaffarpur Complaint Case No. 124 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
