JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-08-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code and sections 11(A),11(D),11(F) and 11(K) of the Prevention of Cruelty to the Animal Act, 1960. It is alleged that five she-buffaloes tied with rope were being taken away by three persons when the local police was informed but the persons who were taking the she-buffaloes, namely, Kishore yadav and Kari Mian did not give any satisfactory reply disclosed the name of third person who managed to escape. The petitioners are not named in the FIR. Their name sprang up in the confessional statement of co accused Kalamuddin

It is submitted by the learned counsel for the petitioners that except confession of the co accused, nothing has been collected against the petitioners. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the fact that recovery of she-buffaloes was not made from the petitioners, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Bettiah, West Champaran in connection with Bettiah Mufassil P.S. Case No.372 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
