2. This application for grant of anticipatory bail, arises out of Manigachhi Police Station Case No. 07 of 2026, registered for the offences punishable under Sections 352, 351(2), 303(2), 109(1), 118(1), 76 and 3(5) of Bharatiya Nyaya Sanhita.
3. As per the First Information Report, the petitioners, along with other accused persons, arrived at the house of the informant, abused, and assaulted her. Petitioner nos. 1 and 4 disrobed the informant and outraged her modesty, and petitioner no. 2 snatched the gold nose pin of the informant, and there is no

Learned counsel for the petitioners submits that both parties are neighbours and there exists previous dispute between them, inasmuch as the daughter of the petitioner's side was kidnapped in the year 2013, for which FIR bearing Manigachhi P.S. Case No. 115 of 2013 was lodged against the informant's side. Thereafter, several cases were filed by both sides against each other. Owing to the said enmity, the present FIR has been instituted on concocted story to implicate all family members. Learned counsel further submits that the allegations regarding disrobing and snatching of the informant's nose pin are ornamental in nature, and there is no specific allegation of assault against the petitioners.
5. On the other hand, learned counsel for the informant vehemently opposed the prayer for anticipatory bail and submits that the petitioners with their common intention, came to the door of the informant, abused and assaulted her, and petitioner nos. 1 and 4 also outraged her modesty.
6. Regards being had to the submissions made by the parties and taking into consideration the previous longstanding dispute between them, and the fact that there is no specific allegation of assault against the petitioners, I am inclined to grant the petitioners privilege of anticipatory bail.

7. This application is, accordingly, allowed.
8. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Darbhanga, in connection with Manigachhi Police Station Case No. 07 of 2026, subject to the condition laid down under Section 482 (2) of the B.N.S.S.
