JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-08-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the informant is languishing in custody since 7.6.2016 in a case registered under Sections 341,323,324,307 and 498A of the Indian Penal Code. The prosecution case is that for a dispute with regard to purchase of fish the petitioner assaulted with Dabia (sharp cutting weapon) indiscriminately to the informant.
It is submitted by the learned counsel for the petitioner that though the injury report reflects multiple injury all over the body of various length and depth but the petitioner also received incised injury on the middle and ring finger. The injury reports have been brought on record as Annexure 2 series. The issue has been reconciled between the parties when the informant has filed
Patna High Court Cr.Misc. No.35652 of 2016 (2) dt.23-08-2016 2/2 compromise petition before the learned court below. Considering the nature of accusation, the period in custody and the retracted version of the informant, let the above named petitioner be released on provisional bail for two months on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Ist, Araria in connection with Jogbani P.S. Case No. 73 of 2016. The provisional bail will be confirmed by the learned court below on verification of the factum of filing of compromise petition by the informant.
