JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-01-2021 Heard learned counsel appearing for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners have been made accused in Suryapura P.S. Case No. 48 of 2019 registered under Sections 341, 323, 307, 354(B0/379/34 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioners have been granted provisional bail by this Court vide order dated 8.10.2020.

The accusation against the petitioners is that they along other accused assaulted the informant and others. The case diary has been received and perusal of case diary goes to show that all the injurds of this case have sustained simple injury said to be caused by hard and blunt

Learned counsel of the petitioners submit that having more or less similar allegation, co-accused Nandu Singh and three others have already been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 16.11.2019 passed in Cr. Misc. No. 51243 of 2019. It is also pointed out on behalf of the petitioners that there is case and counter case between the parties.

Considering the aforesaid facts and circumstances as well as submissions of the parties, the provisional bail granted to the petitioners vide order dated 8.10.2020 is, hereby, confirmed and, accordingly, this anticipatory application stands disposed of.
