The petitioner is apprehending arrest in a case registered for the offences punishable under section 47(a) of Bihar Excise Act.

It is alleged that sixty liters of country made liquor were recovered from the shop of the petitioner. It is submitted by the learned counsel for the petitioner that the seizure list does not contain the signature of any family member of the petitioner and the prosecution report has been transmitted to the learned court below after inordinate delay. Statement has been made in paragraph 3 of the petition that the

Patna High Court Cr.Misc. No.34503 of 2015 (2) dt.17-08-2015 2/2 petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Excise Case No. 20 of 2010 pending in the court of learned JM Ist Class, Gaya. This application is disposed of with the aforesaid observation/direction.
