JUSTICE SHIVAJI PANDEY ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking bail in connection with Kasma P.S. Case No. 14 of 2014 registered for offence under sections 25 (1-B) a, 26, 35 of the Arms Act and 10 U.A.P.A. Act and 17 C.L.A. Act.

The Police raided the congregation from where one person, namely, Awadhesh Yadav along with others, was arrested and from the possession of Awadhesh Yadav, the Police recovered one county made masket and five live cartridges.

The counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner and Awadhesh Yadav, from whose possession the arms were recovered, has already been granted bail by this Court in Cr. Misc. No. 35743 of 2014.

No.32694 of 2016 (2) dt.20-08-2016 2/2 Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Aurangabad in connection with Kasma P.S. Case No. 14 of 2014, subject to the following conditions:-

1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3. The petitioner will be well represented in the court.

4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned. (Shivaji Pandey, J) Mahesh/- U T
