Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323, 354, 379, 448, 504, 506 of the Indian Penal Code.

It is alleged against the petitioner that petitioner assaulted with Khanti on the head of the informant causing bleeding injury. Thereafter other accused persons dragged the informant and co-accused Subodh Mandal and Sintu Mandal assaulted her with lathi and subsequently accused persons took away Rs. 2000/- and silver chain kept in a box.

It is submitted by learned counsel for the petitioner that injury report reflects one lacerated injury of

Patna High Court Cr.Misc. No.33894 of 2015 (2) dt.13-08-2015 2/2 marginal size, simple in nature caused by hard and blunt substance which does not corroborate the accusation as it was specifically alleged that three persons assaulted the informant. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sabour(Goradih) P.S. Case No. 103 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
