JUSTICE SUDHIR SINGH ORAL ORDER 08-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 386 and 387 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that some accused persons came at the wine shop of the informant and demanded extortion money. Thereafter, they started assaulting the staff of the shop and fled away with Rs.40,000/- and two mobile phones.

It has been submitted on behalf of the petitioner that he is in custody since 4.8.2015. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner has falsely been implicated in the present case. He is not named in the F.I.R. He has been made accused on the basis of his confession before the police.

On behalf of the State, it is submitted that though petitioner is not named in the F.I.R. but nine cases are pending against him.

Patna High Court Cr.Misc. No.30897 of 2016 (3) dt.08-09-2016 2/2 Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner, same is rejected. The trial court at Begusarai is directed to take all necessary steps to expedite the trial of the petitioner in connection with Barauni P. S. Case no. 235 of 2015 and conclude the same preferably within a period of seven months from the date of receipt/production of a copy of this order.
