JUSTICE SATYAVRAT VERMA ORAL ORDER 06-01-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State through Virtual Court Proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 324, 326, 307, 504, 506, 498A, 304B and 34 of the Indian Penal Code & Section 3 /4 of the Dowry Prohibition Act.
Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 01.04.2021 and is the father-in-law of the deceased and the husband is in custody and from perusal of the allegation as alleged in the F.I.R, it would manifest that the allegation of demand of dowry is general and omnibus in nature. The informant alleges that he received information that husband sprinkled kerosene oil on the body of the victim
Patna High Court CR. MISC. No.20564 of 2022(3) dt.06-01-2023 2/2 and set her ablaze, it is next submitted that informant is not an eye witness to the occurrence.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner and the fact that husband is in custody, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kewati P.S. Case No. 156 of 2020.
