JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section-307 & other minor sections of the Indian Penal Code and 27 of the Arms Act.

Taking into consideration that petitioner is said to have opened fire of rifle, causing injury on the chest of the informant, I am not inclined to release the petitioner on bail, at least at this stage and accordingly, his prayer for bail in connection with Kharagpur P.S. Case No. 10 of 2016 pending in the court of learned Chief Judicial Magistrate, Munger stands rejected. However, learned Chief Judicial Magistrate, Munger is directed to commit the case of the petitioner in

Patna High Court Cr.Misc. No.34331 of 2016 (2) dt.20-08-2016 2/2 accordance with law within three weeks from the date of receipt/production of copy of this order and after that, the trial court should expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within four months from the date of receipt of record in Sessions court, failing which, the petitioner may renew his prayer for bail before the learned trial court itself.
