The petitioner apprehends his arrest in Chanpatia P.S. Case No. 250 of 2013 registered under section 307 and other allied sections of the Indian Penal Code. The informant made allegation against the petitioner that he assaulted her with farsa causing cut injury on head and other accused persons assaulted with stick. It is submitted that the police after investigation did not found the case true against the petitioner and submitted charge sheet against three accused persons. During the investigation most of the witnesses have stated that petitioner is working in Mumbai and he was not present on the date of occurrence.

Considering the fact that the police after

Patna High Court Cr.Misc. No.40925 of 2014 (3) dt.01-04-2015 2/2 investigation submitted final form finding the case false against the petitioner, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from today is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in Chanpatia P.S. Case No. 250 of 2013, subject to the conditions as laid down under section 438(2) Cr.P.C.
