The petitioner apprehends his arrest in connection with Ekma P.S. Case No.11 of 2023 registered under Sections 30(a), 41(1)(2) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from conscious possession of the petitioner rather recovery has been made from near the house of the petitioner. The petitioner has no concern with the alleged seized liquor.

Having considered the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned

Case No.11 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
