Petitioner seeks bail in Malaypur P.S. Case No.36 of 2018 instituted for the offence under Section(s) 366-A, 120-B, 506 Indian Penal Code.

Counsel for the petitioner submits that victim girl has given statement under Section 164 Cr.P.C., wherein, she has stated that she has voluntarily gone to Delhi with petitioner. It is also submitted that victim has performed marriage with petitioner. In support of which, counsel for the petitioner has annexed marriage certificate and copy of the petition filed by the victim in the Court below as Anenxure-2 and 3. The victim has stated her age as 17 years and the Court has also assessed her age

Patna High Court Cr.Misc. No.57562 of 2018 (2) dt.09-10-2018 2/2 as 17 years.

Petitioner is in custody since 20.07.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui, in connection with Malaypur P.S. Case No.36 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
