2. The petitioner has preferred this application for grant of regular bail in connection with Complaint Case No 92/2021 registered for the offence punishable u/s 323, 420, 406, 468 of the Indian Penal Code.

As per the prosecution case, the complainant, Gangajali Kuer, was earlier married to Ram Bilash Ram and after being blessed with four daughters, her husband solemnized marriage with another lady from whom the present accused petitioner and the co-accused person, Prabhu Ram were born. Thereafter, the piece of land that the complainant was owning

Patna High Court CR. MISC. No.28513 of 2025(3) dt.23-07-2025 2/3 she partitioned the same between her four daughters and even the same were mutated in the concerned Circle Office. However, later the petitioner and the co-accused person, Prabhu Ram showing the complainant as dead and on the basis of certificate issued by the local 'Sarpanch' prepared forged documents and got their names mutated in the Circle Office on her land. Upon knowledge, the present complaint was lodged.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. It is a case of civil nature. Earlier the anticipatory bail of the petitioner has been rejected by the Co-ordinate Bench of this court vide order dated 20.01.2023 passed in Cr. Misc. No. 55728/2022. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 23.01.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of

No.28513 of 2025(3) dt.23-07-2025 3/3 the like amount each to the satisfaction of learned Court concerned, Rohtas at Sasaram in connection with Complaint Case No 92/2021, with the condition ;- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
